General terms and conditions of sale
Article 1 : purpose
Article 2 : provision
The establishment provides :
- An air-conditioned reception room measuring 200 m² that complies with Type L ERP standards for the 4th category, with toilets that comply with disability standards.
- A private terrace measuring over 400 m² adjacent to the reception room.
- Terraces of nearly 500 m² between the château and the cottages.
- Private parking for 130 vehicles.
- A 200 m² restaurant and bar area.
- Access to the landscaped grounds of Château Erigoye.
- Video projector.
- Bedding available if this option has been selected in the rental contract.
GUEST ROOMS AND ACCOMMODATIONS :
Total capacity of 11 rooms, with a base of 30 beds, which can be increased to 50 according to the following description :
- 100 m² “Nuptial” suite with sauna for the bride and groom (2 people)
- 65 m² “Gîte Rive Gauche” duplex with two bedrooms and two bathrooms (4 people + 2 people on a sofa bed)
- 66 m² “Gîte Rive Droite” duplex with two bedrooms and three bathrooms (4 people + 2 people on a sofa bed)
- 50 m² “Vision” duplex for (2 people + 4 people on a sofa bed)
- 60 m² “Family” suite with two bedrooms separated by a bathroom for (4 people)
- 54 m² “Gold” suite with two bedrooms and one bathroom for (4 people)
- 59 m² “Lake” suite with one bedroom and one bathroom for (2 people + 2 people on a sofa bed)
- 28 m² “Poolside” room with one bedroom and one bathroom for (2 people)
- 20 m² “Pine Forest” room with one bedroom and one bathroom for (2 people)
- “Blue” room, 20 m², with one bedroom and one bathroom (sleeps 2)
- “Elle” room, 28 m², with one bedroom and one bathroom (sleeps 2)
- A dormitory offering 10 additional beds
Article 3 : rates and payment terms
The rates for the various services are expressed in euros, including tax. They are determined based on the service, duration, and date of reservation, and are subject to a contract.
The reservation will be confirmed upon receipt of the rental contract and these general terms and conditions of sale,duly dated and signed, as well as a deposit payment of 50% of the contract amount.
The balance of the amount due must be paid no later than 30 days before the start of the rental contract.
Checks should be made payable to SCI ERIGOYE.Bank transfers, cards, and cash payments are also accepted.
Article 4 : conditions for the provision of premises and equipment
EQUIPMENTA) ROOM / PARK
The duration of availability is specified in the rental agreement.
The room is made available according to the dates and times defined in the rental agreement signed alongside thegeneral terms and conditions of sale.
The reception room is air-conditioned and heated as needed by four independent units.
The preparation of the room and the replacement of equipment is the responsibility of the signatory customers.
Waste management is the responsibility of the signatory customers and their service providers.
The landscaped park has a pond.
Access is the sole responsibility of parents.
The installation of equipment, lighting, and any organization of outdoor activities within the park are subject to priorauthorization from management.In order to preserve the visual appearance of the park for your event, the maximum capacity in terms of the number ofvehicles (including service providers) has been set at 92.
For the organization of the event, in particular the decoration and installation of the hall and the park, signatorycustomers may call upon service providers, under their full and entire responsibility and after having taken care to inform them of the rules of these general terms and conditions.
Each service provider must be introduced to the management of the establishment.
Availability times may vary depending on event scheduling.
B) CATERING / CATERING SERVICES
Caterer of your choice. We can recommend a caterer from our selection if required.
C) ACCOMMODATION / BREAKFAST
Reserved rooms are available to guests between 3pm and 7pm on the day of arrival and must be vacated by 11:30 am on the day of departure. Any delay in vacating the room may result in additional charges for daytime use of the accommodation.
Rooms are provided with bed linen and towels.
SCI ERIGOYE is responsible for cleaning rooms reserved for overnight stays with hotel service. If excessive damage isfound, cleaning fees may be charged (€30/person/hour). The duration of availability is specified in the rental contract. Breakfast is served as a buffet in the morning in the designated room at the times indicated in the contract. Quantities are provided according to actual demand. This must be communicated at least the evening before.
The swimming pool area is available when you book your rooms.
It is 17 meters long and 7 meters wide, or nearly 120 m2 with its terraces. The pool is open from 9:30 a.m. to 8 p.m.
Access to the pool ends on Sunday or the day after the rental at 4 p.m.
Minors under the age of 16 must be accompanied by an adult.
D) ANIMATION MUSICALE
M usic may be played and a dance party may be held in the reception hall between 9:00 p.m. and 4:00 a.m.
No non- professional sound engineers/DJs will be allowed to work at the establishment (except for sound engineers/DJs recommended by SCI ERIGOYE).
Therefore, before 9:00 p.m., customers who have signed the contract are free to hire another service provider (band, singer) for musical entertainment during the cocktail reception. Be tween 9:00 p.m. and 4:00 a.m. the following morning, only a professional sound engineer/DJ will be permitted to perform.
The end of the DJ's performance marks the end of all music playback and will in all cases be set at 4 a.m. at the latest. No other sound equipment may be installed by the signatory customers before and after the end of the DJ's performance.
SCI ERIGOYE reserves the right to prohibit access to the establishment by any sound engineer/DJ who is notprofessional and/or not mentioned in the service contract signed with the customers. SCI ERIGOYE reserves the right to stop the dance party at any time if the rules for playing musicestablished by SCI ERIGOYE are not respected (failure to comply with the sound limiter, failure to comply with the schedule, failure to comply with the designated location for the sound engineer/DJ, failure to comply with instructions).
ARTICLE 5 : noise management and responsibilities
RESPONSIBILITIESThe management of SCI ERIGOYE appeals to the good manners of participants regarding any disturbances that may be caused directly by themselves (shouting and/or calling out at night) or by their vehicles (music, revving engines, rapid starts).
Please note that the use of car horns is regulated by French law. We therefore ask you to refrain from honking yourhorn on the public roads around Château Erigoye, out of respect for the neighborhood. The use of horns within the grounds of the establishment (parking lot) is strictly prohibited by management. The management informs you that the reception room is equipped with a sound limiter. This mandatory equipment is designed to limit noise pollution to the neighborhood to a level permitted by French law.
Thus, if the noise level inside the room (doors and windows closed) exceeds the maximum level of 105db, the sound limiter will issue a “penalty.”
Between 11 p.m. and 8 a.m., all entertainment or events must take place inside the building.
All exits (doors and windows) must be kept closed (without the obligation to lock them).
Signatory customers are therefore fully responsible for any failure to comply with the above obligations and recommendations. In the event of a dispute with a third party or intervention by law enforcement, signatory customers undertake to intervene in person to resolve the situation and to accept any consequences.
The management of SCI ERIGOYE must also be informed immediately, regardless of the time of day or night.
Article 6 : prohibitions and responsibilities
It's forbidden to :
- Use fireworks, firecrackers, smoke bombs, or portable horns on the premises (indoors/outdoors).
- The use of sparklers is strictly prohibited in the hall.
- Use fire as part of entertainment (lantern releases, jugglers, fire breathers) or to create atmosphere (only candles integrated into a glass lantern that fully covers the flame are permitted).
- In accordance with the prefectural decree, lantern releases are strictly prohibited within the premises of the establishment and more broadly in the Gironde department.
- Smoking in the room (including electronic cigarettes), accommodation, and indoor common areas of the establishment.
- Subletting or making this room available to anyone other than the signatories of the contract, as well as organizing events for profit.
- Dismantling or modifying equipment or furniture, carrying out work (installing staples, drilling, modifying electrical installations, etc.).
- Make copies of the keys to the hall and bedrooms.
- Move or remove decorative items without prior approval from management.
- Cover or obscure lights and other heat sources with any type of decorative material.
- Set up marquees, reception tents, or any other structures.
- Campers and tents are strictly prohibited on the property.
- Use the room to add extra beds without prior approval from management.
- Add extra beds other than those provided by the establishment in the rooms and apartments.
The use of drones within the premises of the establishment is strictly reserved for professionals who have received prior authorization from the authorities. Any use of drones by a professional within the premises of the establishment must first be approved by management.
Only biodegradable balloons are permitted, subject to compliance with the rules imposed by the Gironde Prefecture and the Ministry of the Environment, Energy, and the Sea (see website : http://www.developpement-durable.gouv.fr/Demande-de-lacher-de-ballons.html). The establishment cannot be held responsible for any breach of these rules and will systematically ask signatory customers to provide proof of prefectural authorization prior to any balloon release.
Signatory customers are fully responsible for any failure to comply with the above prohibitions by themselves ortheir guests. Management therefore strongly advises signatory customers to inform their guests, witnesses, and event organizers, who may be planning surprises for them, of the proper application of the various rules and prohibitions.
Article 7 : animals
D ogs are allowed on the premises, but must be kept on a leash at all times. Their waste must be picked up and disposed of in the trash containers. Under no circumstances may they be left alone in any of the accommodations on the premises.
The presence of any other animal (other than a dog) on the premises must be subject to prior approval by management.
Please respect the peace and quiet of the animals on the property.
Article 8 : insurance against damage, deterioration, and theft
The premises are insured for lunches or dinners for 160 seated guests. If this number is exceeded, the establishment declines all responsibility in the event of an accident.
Under no circumstances can the establishment be held liable for damage of any kind, in particular theft, affecting goods, personal belongings, vehicles, or equipment brought into the establishment by the signatory customers or their guests.
The customer must ensure that they have taken out an insurance policy (civil liability insurance for the event in question) and present proof of this to the management of Château Erigoye no later than when the keys are handed over.
Article 9 : inventory of fixtures
A visual inspection of any anomalies/damage reported in the inventory will be carried out when the keys are handed over in the presence of the signatory customers and the management of SCI ERIGOYE.
The management of SCI ERIGOYE undertakes to provide its customers with accommodation and common areas in good condition and free from damage or hidden defects. Any anomalies and/or damage during the rental period must be reported to the management as soon as possible. The management of SCI ERIGOYE grants itself a period of 7 days after the rental to report and record (on site or by photo)to the signatory customers any damage not reported during the exit inventory, provided that the accommodation or equipment concerned is not used by another customer after the rental.
A deposit check for €3,000 and another for €250 for cleaning will be requested before the keys are handed over. Thisdeposit covers any damage caused during the rental period as well as any outstanding amounts on the final bill. It willbe returned by mail if no damage or breaches are found and if all amounts due on the final bill have been paid.If any damage or missing equipment is noted during the exit inventory, or within a maximum of seven days followingthe rental for the accommodation and common areas, the deposit check will be retained for the time necessary tocover the repair or replacement of the missing equipment. A quote for repairs or purchases will then be provided. This will be charged to the signatory customers and/or their insurance company.
In the event of non-payment of the final invoice, a reminder will be sent to you by email or post. If no payment is received within 7 days, the deposit check will be cashed and the difference will then be refunded to you by bank transfer. If the security deposit proves insufficient and in the event that their insurance does not cover the costs, the signatory customers undertake to make up the difference on the basis of supporting documents provided by the management of SCI ERIGOYE (invoice, estimate).
Before returning the room, all waste must be removed and decorations taken down, taking care to remove anyfastenings (string, thumbtacks, nails). The floor of the room must be swept to collect anything that cannot be vacuumed(party favors, bottle caps, etc.). Brooms are available in the catering area. The cleaning of floors, windows, and restrooms is included in the package and is provided by the establishment. Signatory customers also agree to restore the exterior surroundings of the establishment by picking up any waste, uncollected glasses or bottles, and all decorative items.
Article 10 :
Any request to modify the initial reservation must be sent in writing to SCI ERIGOYE.
If SCI ERIGOYE management does not provide written acceptance within 7 days of receiving the request, the contract shall be deemed to continue under the terms and conditions currently accepted by the signatory customers. Any cancellation initiated by the signatory customers must be sent to us in writing by registered letter with acknowledgment of receipt.
Financial penalties in the event of cancellation of the reservation are determined as follows :
- In the event of cancellation more than 180 days before the start date of the rental and after the expiry of the legal withdrawal period of 14 days : 50% of the total amount of the rental contract will be invoiced by SCI ERIGOYE as cancellation fees to the signatory customers.
- In the event of cancellation 180 days or less before the start date of the rental and after the expiry of the 14- day legal withdrawal period : 100% of the total amount of the contract will be charged by SCI ERIGOYE to th e signatory customers. The man agement would like to draw your attention to the fact that no “force majeure” (death, illness, disability, etc.) can be invoked to claim a refund from SCI ERIGOYE for deposits paid. Only a guarantee, through insurance specifically taken out for your event, could cover you in th ese particular cases.
Any cancellation initiated by the management of SCI ERIGOYE for the following reasons only will be subject to a 100% refund of the deposit paid, without giving rise to any right to compensation :
- The total or partial destruction of the establishment, resulting in its closure
- The cessation of activity by SCI ERIGOYE.
Article 11 : final provision
In the event of non-compliance with these general terms and conditions, the management of SCI ERIGOYE reserves theright :
- to terminate the contract,
- to refuse any new rental requests,
- to deduct the amount of the damage from the deposit paid in advance and to issue an invoice if thisamount exceeds the deposit,
- to take legal action in the event of malicious use of the premises and equipment made available or failure tocomply with the clauses of these general terms and conditions.
In the event of a dispute, the parties undertake to seek an amicable solution first. Only French law is applicable to this contract. For any disputes arising from the performance or termination of this contract, only the courts within the jurisdiction of SCI ERIGOYE shall have jurisdiction.
